Terms of Service

Please read these Terms of Service carefully before using Fwago. By accessing or using our platform, you agree to be bound by these terms. If you do not agree, do not use Fwago.

1. About Fwago

Fwago is a lease transfer platform that facilitates the verified handover of residential tenancies between outgoing tenants, incoming tenants, and property owners in Nigeria. We provide a marketplace, verification services, and coordination infrastructure. We are not a party to any tenancy agreement and do not own, manage, or control any property listed on our platform.

3.1 Outgoing Tenants

An outgoing tenant is a person currently holding an active tenancy agreement who wishes to transfer their remaining lease period to a verified incoming tenant through Fwago. By listing a lease on Fwago, you confirm that:

4. The Transfer Process

A Fwago lease transfer proceeds as follows:

  1. The outgoing tenant submits a lease listing with supporting documents
  2. Fwago verifies the submission within 48 hours and confirms authenticity
  3. A verified incoming tenant is matched and expresses interest
  4. Fwago contacts the landlord to confirm the existing tenancy and request approval for the transfer
  5. The landlord reviews the incoming tenant profile and approves or declines
  6. Upon approval, the incoming tenant signs a new tenancy agreement with the landlord
  7. Payment is processed, with the outgoing tenant receiving their recovery amount and the landlord receiving the balance
  8. The transfer is completed and the outgoing tenant is formally released from the tenancy

Important: No transfer is complete until the landlord has given explicit written approval and a new tenancy agreement has been signed. Fwago does not guarantee that any transfer will be approved or completed.

5. Fees and Payments

5.1 Outgoing Tenant Fee

Fwago charges a 10% success fee calculated on the value of the remaining lease period recovered. This fee is deducted only when a transfer is successfully completed and approved. If a transfer does not complete for any reason, no fee is charged to the outgoing tenant.

5.2 Incoming Tenant

Incoming tenants pay no platform fee to Fwago. They pay the rent and any charges required directly by the property terms agreed with the landlord.

5.3 Landlords

Landlord registration and participation in Fwago is free of charge.

5.4 Escrow

Where applicable, funds are held in escrow via licensed payment service providers and released only upon confirmation of a successful handover by all parties. Fwago is not responsible for delays caused by payment service providers or other third-party processors.

6. Verification and Identity

Fwago conducts identity and document verification as part of its service. By submitting your NIN, documents, and personal information, you authorise Fwago to verify your identity against government databases and cross-reference your details against submitted documents. Providing false, misleading, or fraudulent information is a serious violation of these terms and may result in immediate removal from the platform, forfeiture of any fees paid, and referral to appropriate law enforcement authorities.

Fwago is a platform and coordination service. We are not a party to any tenancy agreement between users and landlords. We do not:

9. Dispute Resolution

In the event of a dispute between users, Fwago will make reasonable efforts to mediate and assist in resolution. However, Fwago's determination in any dispute is not legally binding and does not replace formal legal proceedings. All disputes arising from use of Fwago shall be governed by the laws of the Federal Republic of Nigeria, and parties consent to the exclusive jurisdiction of Nigerian courts.

10. Limitation of Liability

To the fullest extent permitted by Nigerian law, Fwago shall not be liable for:

11. Intellectual Property

All content, branding, software, and materials on the Fwago platform are the intellectual property of Fwago and may not be reproduced, distributed, or used without our prior written consent. The Fwago name, logo, and "Lease Transfer" category positioning are proprietary.

12. Termination

Fwago reserves the right to suspend or terminate any user account at any time, with or without notice, where we reasonably believe a user has violated these terms, submitted fraudulent information, or engaged in conduct harmful to other users or the platform. Users may close their account at any time by contacting hello@fwago.com.

13. Changes to These Terms

We may update these Terms of Service from time to time. Material changes will be communicated via email or WhatsApp. Continued use of Fwago after any changes constitutes acceptance of the updated terms.

14. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Federal Republic of Nigeria, including but not limited to the Nigeria Data Protection Act 2023, the Consumer Protection Act, and applicable tenancy laws in the relevant state of operation.
